Welcome to Amazon Relay. Amazon EU Société à responsabilité limitée and/or its affiliates (“Amazon”) provide website features and other products and services to you when you visit relay.amazon.com, use Amazon products or services, use Amazon applications for mobile, or use software provided by Amazon in connection with any of the foregoing (collectively, “Amazon Services”). Amazon provides the Amazon Services subject to the following conditions of use (these “Conditions of Use”). By using the Amazon Services, you agree to these Conditions of Use. Please read them carefully. In addition, when you provide any services to or on behalf of Amazon, you also will be subject to terms of service or other applicable agreements governing those services (the “Agreement”).

ELECTRONIC COMMUNICATIONS

LICENSE AND ACCESS

Subject to your compliance with these Conditions of Use, Amazon or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicenseable license to access and make use of the Amazon Services for the sole and exclusive purpose for which the applicable Amazon Services were designed. This license does not include any resale or commercial use of any Amazon Service or its contents; any derivative use of any Amazon Service or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Conditions of Use are reserved and retained by Amazon or its licensors, suppliers, publishers, rightsholders, or other content providers. No Amazon Service, nor any part of any Amazon Service may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose other than those expressly contemplated under these Conditions of Use without the express written consent of Amazon. YOUR ACCOUNT

You may need your own Amazon.com account to use certain Amazon Services, and you may be required to be logged in to the account and have a valid method to receive payment associated with it. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. Amazon reserves the right to refuse service, terminate accounts, terminate your rights to use Amazon Services, remove or edit content in its sole discretion.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

To the extent such functionality is present, authorized users may post reviews, comments and other content, and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content. Amazon reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, you grant Amazon a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Amazon and sublicensees the right to use the name that you submit in connection with such content, if they choose.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate these Conditions of Use and will not cause injury to any person or entity; and that you will indemnify Amazon for all claims resulting from content you supply. Amazon has the right but not the obligation to monitor and edit or remove any activity or content. SANCTIONS AND EXPORT POLICY

You may not use any Amazon Service if you are subject to sanctions or otherwise designated on any list of prohibited or restricted parties or owned or controlled by such a party, including but not limited to the lists maintained by the United Nations Security Council, the European Union or its member states, or by any government authority in the country where you are using Amazon Services. You must comply with all applicable export and re-export restrictions that may apply to goods, software (including Amazon Software), technology, and services.

We are not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals (including the content of their Web sites). APPLICABLE LAW

By using any Amazon Service, you agree that the laws of Grand Duchy of Luxembourg, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Amazon.

MODIFICATION AND SEVERABILITY

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions is deemed invalid, void or for any reason unenforceable, that condition is deemed severable and will not affect the validity and enforceability of any remaining condition.

ADDITIONAL AMAZON SOFTWARE TERMS

 

The following terms (“Software Terms”) apply to any software (including any updates or upgrades to the software) and any related documentation we make available to you in connection with Amazon Services (the "Amazon Software").

1.    Use of the Amazon Software. You may use Amazon Software solely for purposes of enabling you to use the Amazon Services as provided by Amazon, and as permitted by these Conditions of Use. You may not incorporate any portion of the Amazon Software into other programs or compile any portion of it in combination with other programs, or otherwise copy (except to exercise rights granted in this section), modify, create derivative works of, distribute, assign any rights to, or license the Amazon Software in whole or in part. All software used in any Amazon Service is the property of Amazon or its software suppliers and is protected by Luxembourg and international copyright laws.

 

2.    Use of Third Party Services. When you use the Amazon Software, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile software provider. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.

 

3.    No Reverse Engineering. You may not reverse engineer, decompile or disassemble, tamper with, or bypass any security associated with the Amazon Software, whether in whole or in part.

 

4.    Updates. We may offer automatic or manual updates to the Amazon Software at any time and without notice to you.

 

5.    Conflicts. In the event of any conflict between these Conditions of Use and any other Amazon or third-party terms applicable to any portion of Amazon Software, such as open-source license terms, such other terms will control as to that portion of the Amazon Software and to the extent of the conflict.

NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT

If you believe that your work has been copied in a way that constitutes copyright infringement, please submit your complaint using our online form.  We respond quickly to the concerns of rights owners about any alleged infringement. If you prefer to submit a report in writing, please provide us with this information:

- A physical signature of the person authorized to act on behalf of the owner of the copyright interest;

- A description of the copyrighted work that you claim has been infringed upon;

- A description of where the material that you claim is infringing is located on the site;

- Your address, telephone number, and e-mail address;

- A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf..

By using the Relay mobile application, you are accepting the practices described in this Privacy Notice.

CONTROLLERS OF PERSONAL INFORMATION

WHAT PERSONAL INFORMATION ABOUT CUSTOMERS DOES AMAZON EU COLLECT?

Amazon EU receives and stores any information you enter on our Relay mobile application, while providing transportation services, and through other interactions and communications you have with us or our Relay mobile application. The Relay mobile application may provide Amazon EU with data about your use of the Relay mobile application, your geo-location and related tracking data, and other personally identifiable information. For example, the Relay mobile application may allow Amazon EU to see:-

  • When you are at a collection or delivery location, and what time you arrive and leave there;
  • Your progress on a trip.

FOR WHAT PURPOSES DOES AMAZON EU PROCESS YOUR PERSONAL INFORMATION?

Amazon EU may use any such information in connection with the performance of the transportation services you provide, for example:-

  • Delivery of products. We use your personal information to enable you to check-in to collection and delivery locations and to enable us to track progress through a delivery route to identify possible transit delays and take steps to mitigate such delays.
  • Provide, troubleshoot, and improve Relay Services. We use your personal information to provide functionality, analyse performance, fix errors, and improve usability and effectiveness of the Relay Services.
  • Recommendations and personalisation. We use your personal information to recommend features, products, and services that might be of interest to you, identify your preferences, and personalise your experience with Relay Services.
  • Comply with legal obligations. In certain cases, we have a legal obligation to collect and process your personal information.
  • Communicate with you. We use your personal information to communicate with you in relation to Relay Services via different channels (e.g., by phone, email, chat).
  • Fraud Prevention and Credit Risks. We process personal information to prevent and detect fraud and abuse in order to protect the security of our customers, Amazon EU, and others. We may also use scoring methods to assess and manage credit risks.
  • Purposes for which we seek your consent. We may also ask for your consent to process your personal information for a specific purpose that we communicate to you. When you consent to our processing your personal information for a specified purpose, you may withdraw your consent at any time and we will stop processing of your data for that purpose.

WHAT ABOUT COOKIES?

To enable our systems to recognise your browser or device and to provide Relay Services to you, we may use cookies, pixels, and other technologies (collectively, "cookies") to recognise your browser or device, learn more about your interests, and provide you with essential features and services and for additional purposes, including:

  • Recognising you when you sign-in to use Relay Services. This allows us to display personalised content and provide other customised features and services.
  • Conducting research and diagnostics to improve Amazon EU's content, products, and services.
  • Preventing fraudulent activity.
  • Improving security.
  • Reporting. This allows us to measure and analyse the performance of our services.

You can manage browser cookies through your browser settings. The 'Help' feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, how to disable cookies, and when cookies will expire. If you disable all cookies on your browser, neither we nor third parties will transfer cookies to your browser. If you do this, however, you may have to manually adjust some preferences every time you visit a site and some features and services may not work.

DOES AMAZON EU SHARE YOUR PERSONAL INFORMATION?

Amazon EU shares your information only as described below and with Amazon.com, Inc. and the subsidiaries that Amazon.com, Inc. controls that are either subject to this Privacy Notice or follow practices at least as protective as those described in this Privacy Notice.

  • Third Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples include sending postal mail and e-mail, removing repetitive information from customer lists, analysing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content, scoring credit risk, and providing customer service. These third party service providers have access to personal information needed to perform their functions, but may not use it for other purposes. Further, they must process the personal information in accordance with this Privacy Notice and as permitted by applicable data protection laws.
  • Business Transfers: As we continue to develop our business, we might sell or buy other businesses or services. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the customer consents otherwise). Also, in the unlikely event that Amazon.com, Inc. (Amazon EU’s ultimate parent company) or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.
  • Protection of Amazon EU and Others: We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Conditions of Use and other agreements; or protect the rights, property, or safety of Amazon EU, our users, or others. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction.
  • Other than as set out above, you will receive notice when personal information about you might be shared with third parties and you will have an opportunity to choose not to share the information.

Whenever we transfer personal information to countries outside of the European Economic Area in the course of sharing information as set out above, we will ensure that the information is transferred in accordance with this Privacy Notice and as permitted by the applicable laws on data protection.

HOW SECURE IS INFORMATION ABOUT ME?

We design our systems and devices with your security and privacy in mind.

  • We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.
  • We follow the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data.
  • We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal customer information. Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.
  • It is important for you to protect against unauthorised access to your password and to your computers, devices, and applications. Be sure to sign out when you finish using a shared computer. Click on the “Hi, [your name]” drop-down menu and click “Sign Out”.

WHAT INFORMATION CAN I ACCESS?

You can access your information, including your name, contact details and profile information in the "Your Profile" section of the Relay mobile application. You can update your information through the “Your Profile” section of the Relay mobile application. When you update information, we usually keep a copy of the previous version for our records.

In addition, subject to applicable law, you have the right to request access to, correct, and delete your personal data, and to ask for data portability. You may also object to our processing of your personal data or ask that we restrict the processing of your personal data in certain instances. If you wish to do any of these things, you can do by sending us an e-mail to: dsar-relay@amazon.lu.

HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?

We keep your personal information to enable your continued use of Relay Services, for as long as it is required in order to fulfil the relevant purposes described in this Privacy Notice, as may be required by law such as for tax and accounting purposes, or as otherwise communicated to you.

You can file a complaint with our principal supervisory authority, the Commission Nationale pour la Protection des Données in Luxembourg www.cnpd.lu, or with a local authority.

Our business changes constantly and our Privacy Notice will change also. You should check our website frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.

As explained we sometimes provide personal information to third parties to perform services on our behalf. If we transfer personal information received under the Privacy Shield to a third party, the third party's access, use, and disclosure of the personal data must also be in compliance with our Privacy Shield obligations, and we will remain liable under the Privacy Shield for any failure to do so by the third party unless we prove we are not responsible for the event giving rise to the damage.
